Usage Policy Print E-mail
This Usage Policy governs the use of Web Hosting, Virtual Private Server, Dedicated Server, and other Internet services provided by Market Pro Associates ("MP Diyweb Solution"). Violation of this Usage Policy may result in suspension or termination of your service, or legal action. In the event of a dispute between you and MP Diyweb Solution regarding the interpretation of this Usage Policy, MP Diyweb Solution's interpretation, in its reasonable commercial judgment, shall govern. Offensive Content
You may not publish or transmit via MP Diyweb Solution's service any content that MP Diyweb Solution reasonably believes: 
  1. constitutes child pornography; 
  2. constitutes pornography; 
  3. is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech; 
  4. is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes; 
  5. is defamatory or violates a person's privacy; 
  6. creates a risk to a person's safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement; 
  7. improperly exposes trade secrets or other confidential or proprietary information of another person; 
  8. is intended to assist others in defeating technical copyright protections;
  9. clearly infringes on another person's trade or service mark, patent, or other property right; 
  10. promotes illegal drugs, violates export control laws, relates to illegal gambling, or illegal arms trafficking; 
  11. is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to MP Diyweb Solution; or 
  12. is otherwise malicious, fraudulent, or may result in retaliation against MP Diyweb Solution by offended viewers. 
    13. Content "published or transmitted" via MP Diyweb Solution's service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by Market Pro Associates. 


Security
You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically. You must protect your account against from, including, but not limited to, virus, spy, Trojan horse and other harmful materials.


Bulk Commercial E-Mail 
MP Diyweb Solution customers, and/or customers of resellers of MP Diyweb Solution are prohibited from sending Spam Mail.

Customers subscribing Website Solution services MUST comply to this spamming mail policy on which spamming activities are strictly prohibited. Website Solution defines spamming activities as unsolicited broadcast of bulk or commercial email (UBE/UCE) that is sent to addresses that do not affirmativetly and verifiably request such material from that specific sender, including but not limited to mailing of advertising, informational announcements, surveys, website addresses and email addresses. 

  1. MP Diyweb Solution customers, and/or customers of resellers of  MP Diyweb Solution are prohibited from sending UBE/UCE. Customers are required to produce records that verify that explicit affirmative permission was obtained from a recipient before a mailing was sent, if spamming activity is suspected. MP Diyweb Solution may consider the lack of such proof of explicit affirmative permission of a questionable mailing UBE/UCE at its sole discretion.
  2. Market Pro Associates customers are prohibited from maintaining an open mail relay, which is used for the distribution of UBE or UCE or designated as mail relaying. Infractions of this policy may result in a discontinuation of service without prior notice.
  3. Valid complaints received by MP Diyweb Solution will be forwarded to customer for a response and resolution. If no response is then received within twenty-four (24) hours from the said customer, Market Pro Associates reserves the right to suspend or even terminate services to the customer account without prior notice until the problem is resolved and necessary preventive measures are implemented to prevent the violation from recurring.
MP Diyweb Solution customer is responsible for itself and its customers/end-users for Unsolicited Broadcast Email (UBE) or Unsolicited Commercial Email (UCE) by contract. This spamming policy should be complied by customers in order to protect our customers and the internet community from the negative effects of spamming related activity.
MP Diyweb Solution classifies spamming as sending Unsolicited Broadcast Email (UBE) or Unsolicited Commercial Email (UCE) that is sent to individuals who did not specifically request such material, including but not limited to mailing of advertising, informational announcements, surveys, website addresses and email addresses.  Spamming activities are strictly prohibited for customers subscribing MP Diyweb Solution’s services.

Material Protected by Copyright
  1. You may not publish, distribute, or otherwise copy in any manner any music, video, graphic, software, art, articles or other work protected by copyright law, including but not limited to 
  2. Pirate software, Hacker programs or archives, Warez sites, illicit music sites, MP3s, MPEGs, ROMs, and ROM emulators 
  3. Unless you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner;
  4. You may not install Pirate software (software without appropriate license), Hacker programs, etc onto hosting server, virtual private server, or dedicated servers.
MP Diyweb Solution will terminate the service of copyright infringers.

If you believe your copyright is being infringed by a person using the MP Diyweb Solution network, please send your written notice of copyright infringement to:

Your notice must include the following:
  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; 
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted words at a single site are covered by a single notification, a representative list of such works at that site; 
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Website Solution to locate the material; 
  4. Information reasonably sufficient to permit Website Solution to contact you, such as an address, telephone number, and, if available, an e-mail address; 
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner's agent, or the law; 
  6. A statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Internet Abuse
You may not engage in illegal, abusive, or irresponsible behavior, including, but not limited to: 
  1. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to MP Diyweb Solution and its customers) without express authorization of the owner of the system or network; 
  2. monitoring data or traffic on any network or system without the authorization of the owner of the system or network; 
  3. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; 
  4. Use of an Internet account or computer without the owner's authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning; 
  5. Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or 
  6. Any conduct that is likely to result in retaliation against the MP Diyweb Solution's network.
    7. Use of MP Diyweb Solution's network in a way that significantly interferes with MP Diyweb Solution's other customers use of the network, including, but not limited to, download site, MP3, game server, etc. 

Other
You must have valid and current information on file with your domain name registrar for any domain hosted on the MP Diyweb Solution's network.
